Terms of Use

Article 1 - Preamble

These General Terms and Conditions of Sale (GTC) apply to all properties rented by Gîtes Elusate (Christophe LEONI). The premises are rented exclusively for use as seasonal tourist accommodation and cannot be used for any other purposes. By making an online reservation, the Client declares that they accept all of these GTCs as well as the Internal Regulations of our lodgings. The latter are freely available in their entirety on our website giteselusate.com.

Article 2 - Price

Gîtes Elusate reserves the right to modify its prices at any time. All stays are billed based on the rates in effect announced online at the time of booking registration. The prices are inclusive of all taxes (TTC) and are expressed in Euros. They are per accommodation and per night, unless otherwise stated. The tourist tax is added to the total amount at the time of booking. If the client wishes to add optional additional services, the amount of these services is calculated and added to the final amount at the time of booking or will be invoiced separately if the client requests it after booking. Our product offers and prices are valid as long as they are visible on the website.

Article 3 - Reservation and Payment

Online payment is secure. Your reservations are paid for by credit card directly on giteselusate.com. To increase payment security when ordering by phone, the credit card's cryptogram, a copy of an ID card, and the credit card may be requested to validate the reservation. These items will be communicated by email. In any event, the information and documents relating to the reservation must be received within 10 (ten) working days before taking possession of the furnished tourist accommodation.

Article 4 - Deposit

A deposit is required for all reservations. The deposit is taken by our partner Swikly, on behalf of Gîtes Elusate, an email is sent to the Client 3 days before their arrival to complete the operation. It is a bank imprint. By booking, the client accepts the general conditions of our partner Swikly. Access to the accommodation cannot be given if the deposit is not secured.

The amount of the deposit is 250€ per lodging and per reservation.

Gîtes Elusate will be responsible in the event of a dispute concerning any damage or compensation arising from the stay and will take care of the management of the deposits with Swikly as well as the management of any damages and compensation.

The deposit will be released within 30 days following the Client's departure after it is determined that no damage, stains, breakage, disappearance of objects, movement of furniture/objects, or damage requiring repairs has been caused by the Client. The client will be held responsible for any broken or damaged items and for any damage that may be caused to the installations during the duration of their stay. Smoking is strictly prohibited inside all of our lodgings.

Clients must properly dispose of their cigarette butts (e.g. in the ashtrays provided) and must not under any circumstances throw them on the Property's grounds or on the public road. Failure to comply with this rule will result in a deduction from the security deposit.

Article 5 - Inventory

The client must report any anomalies or damages within 4 hours of arrival. Beyond this time, any damages or anomalies may be charged to the client if they have not been reported. The client must check the condition of the accommodation upon arrival. If no feedback is provided to Gîtes Elusate, the accommodation and its equipment are deemed to be in good condition.

Upon departure, the maintenance team will conduct a check-out inspection, and any damages or anomalies found will be communicated by email, along with the corresponding invoice.

As check-out is autonomous in Gîtes Elusate, the client is not assisted during the process. The check-out inspection is therefore carried out after the client's departure and cannot be contested.

The furnished accommodations are fully equipped with tableware, cutlery, bedding, household and bath linen, and appliances. It is expressly forbidden to use the beds without sheets. It is also forbidden to keep shoes on the beds and sofas.

Article 6 - Modification of the reservation

If the client wishes to make changes to the reservation, once confirmed, Gîtes Elusate will do its best to accommodate them. However, if this proves impossible, the client may request the cancellation of the original reservation, which will be subject to the cancellation conditions set out in Article 7.

In the event of illegal activities or disturbances in the neighborhood, Gîtes Elusate reserves the right to cancel the stay without compensation by blocking access codes and returning the keys. In this case, no refund of the amounts paid will be made by Gîtes Elusate. Any recourse must then be made to Gîtes Elusate or before the competent courts (Article 11).

Article 7 - Cancellation policy

In the event of cancellation by the client, for any reason, this must be notified to Gîtes Elusate or the booking platform by email. A percentage of the amount paid will remain definitively acquired by Gîtes Elusate as a file processing fee and late cancellation compensation. In accordance with the terms below:

· Up to 1 month before the arrival date: full refund, except for service fees.

· Between 1 month and 7 days before the arrival date: 50% refund of the total amount of the reservation.

· Less than 7 days before arrival: no refund.

· For reservations made on a booking platform such as Airbnb.com, Booking.com, or other, the conditions mentioned on the platform apply.

If the cancellation takes place within 48 hours of the reservation, the client is refunded 100%.

In case of no-show, no refund will be made.

If your arrival is delayed after the scheduled arrival date or if you leave earlier than the scheduled departure date, no refund or modification can be made to your initial reservation confirmation under any circumstances. We strongly recommend that you take out adequate holiday cancellation insurance.

Article 8 - Departure from the accommodation

Before your departure, we ask you to:

· Do your dishes;

· Make sure the accommodation is not abnormally dirty;

· Close all doors and shutters;

· Return the key to the key box (or close the door behind you for the Gîte "La Familiale").

Article 9 - Applicable fees

Non-compliance with the internal rules may result in additional charges. These charges are, but not limited to: 250€

Noise disturbances: Noise disturbances and nighttime (or daytime) disturbance are strictly prohibited. In the event of non-compliance with this condition, fees will be deducted from the deposit (250.00€). The suspension of the stay may also be imposed by simple request from the agency La Conciergerie Le Sud or the public authority without any refund.

Intensive cleaning supplement: The cleaning fees are already included in your reservation. However, if the cleaning staff reports an abnormally dirty accommodation after the Client's departure, a flat penalty of 50€ will be charged.

Dishes: A dish supplement of 15€ will be charged if our cleaning staff has to do your dishes.

Bed linen: In case of a stain that cannot be removed from a flat sheet or pillowcase after laundering, a flat fee of 50€ will be charged for the replacement of the sheet or pillowcase.

Towel: In case of a stain that cannot be removed from a towel, a flat fee of 35€ will be charged for the replacement of the towel.

Bedspread and headboard: In case of a stain on a bedspread or headboard, a flat fee of 50€ will be charged for laundering.

Breakage: In case of breakage of an object present in the accommodation, the replacement cost will be charged to the Client based on the replacement rate.

Damage: In case of damage to the accommodation, the repair cost will be charged to the Client according to an estimate.

These fees will be deducted directly from the security deposit before it is returned to the Client. If the deposit is not sufficient to cover the amount of damage, Gîte Elusate reserves the right to request payment from the Client for the repair or replacement costs.

Article 10 - Complaint and Dispute

Any possible complaint during the stay must be reported immediately by the Client to Gîte Elusate. If the problem encountered could not be resolved immediately, the Client should send a detailed complaint by email as soon as possible to allow Gîte Elusate to propose a solution. The Client cannot claim any compensation in case of urgent repairs to be carried out during his stay inside the accommodation.

Article 11 - Jurisdiction

The parties expressly agree that the Auch High Court shall have jurisdiction.
